Abstract/Description or Keywords | The Provincial government enacted the Riparian Areas Regulation (RAR) in 2005, in order to protect the integrity of streams and fish habitat, in areas of the province subject to development pressure1 . Local governments were (and are) required to implement this regulation. One of the vehicles for implementing the RAR is to establish Development Permit Areas associated with RAR-subject streams. In 2007, Islands Trust contracted a Qualified Environmental Professional (QEP), Kathy Reimer, RPBio, to confirm which streams on Mayne Island are subject to the RAR. Three streams were thus determined to be subject to the regulation: Deacon Creek, Campbell Creek and Horton Creek. GIS mapping was undertaken delineating the main stems of these streams, and report was produced summarising results. Landowners on Mayne Island disputed the findings of this study, thus Islands Trust contracted QEP Lehna Malmkvist, RPBio of Swell Environmental Consulting to provide a review of of these watercourses to provide an additional professional opinion regarding the applicability of the RAR. This report summarises the results of this review, including clarification of the RAR and a description of observations made in the field and from airphotos.
